When a car hits a bike, the process for being compensated is different from the process when a car hits another car. You don’t have to have insurance to ride your bike, but you do have to have insurance to drive a car.

In a car-car collision, each driver’s insurance covers their own “Section B” benefits. These cover some treatments and income loss after an accident for up to two years. The driver who was not at fault may have a claim against the other person’s insurance as well. The other person’s insurance is called the “Third Party Insurer”.

In a car-car injury collision, the process is usually (1) treat your injuries and then claim the cost of treatment from your own insurer , and (2) claim the other losses from the collision from the other person’s insurer.

In a car-bicycle collision, there is only one insurance company – the one for the driver of the car. In this case, that insurance company is the Section B Insurer and the Third Party Insurer. That means you still get Section B coverage, but you will need to claim from the same Insurer for both.
