Sometimes we hear from the insurance industry that there is no way that our clients should have suffered any injuries given the speed at which the vehicles collided. I have been in this business long enough to understand that there really is no rhyme or reason why some people are in very significant accidents and do not suffer any serious injuries, whereas others are in relatively minor accidents and suffer lifelong injuries. There are numerous factors that contribute to injuries in accidents. These factors include the age of the person, the type and size of vehicle they were driving at the time of the collision, the size and type of vehicle that hits them, the position of their arms and head at the time of impact, and obviously whether they had any preexisting medical issues or predisposition to injury.


Over the years, I have had many clients who were in relatively minor accidents who suffered significant injuries and vice versa. Insurance companies went through a phase where they were hiring engineers to try and prove that low velocity impacts could not result in injury. They seem to have given up on that approach has it simply is not scientifically defendable.
