What should you do?
Physiotherapists are notorious for describing ‘soft tissue’ injuries as ‘minor’. This is just simply wrong. This is NOT what the law says. The Minor Injury Regulations states that injuries to the muscles, ligaments and tendons MAY be ‘capped’ as a minor injury. However, if you do not recover from your injuries within the first 6 months after the collision, your injuries/pain may be classified as being ‘chronic’ and therefore NOT capped. Also, even if you do not suffer from chronic injuries/pain, your claim may NOT be capped if there is a inability to do activities of daily living (eg. activities around the house, hobbies, etc.) or do such activities without pain and you are not expected to see much improvement in the future.
